  Pan Yue, deputy director of the State Environmental Protection Administration, informed the press today that the first batch of "high pollution and high environmental risk" products catalogue of the State Environmental Protection Administration in 2008 (referred to as "double high" products catalogue) involved 141 kinds of "double high" products in six industries. In view of the 39 products of pesticides, paints, batteries and organic arsenic that are currently entitled to export tax rebates in the list, the Environmental Protection Administration has proposed to the Ministry of Finance and the State Administration of Taxation to cancel their export tax rebates, and at the same time, it has also proposed to the commerce and customs departments to prohibit their processing trade. Pan Yue said that as one of the basic contents of the green trade policy, the establishment of this directory is not only an urgent need to limit the "two high" industries and protect public health, but also a practical action for China to fulfill its international environmental protection obligations.

  Pan Yue introduced that "highly polluting" products refer to products that are seriously polluted and difficult to control in the production process; "High environmental risk" products refer to products that are prone to pollution accidents and endanger the environment and human health during production, transportation and storage. Among the 141 products listed in this catalogue, there are 16 products with high pollution and 63 products with high environmental risk, and 62 products with both high pollution and high environmental risk. In the general catalogue, pesticides involve 24 products such as DDT, inorganic salts involve 25 products such as sodium cyanide, batteries involve 8 products such as cadmium-nickel batteries, paints involve 21 products such as lead oxide, dyes involve 43 products such as acid red, and organic arsenic involves 20 products such as arsonic acid.

  Pan Yue said that the establishment of the "Double High" product list is an important measure for the Environmental Protection Administration to implement the State Council’s "Comprehensive Work Plan for Energy Conservation and Emission Reduction" and establish an environmental and economic policy system. This is not only conducive to optimizing economic growth through environmental protection and better promoting the adjustment of industrial structure, but also conducive to better protecting public environmental safety and public health by controlling the production and use of "double high" products.

  Pan Yue said that the production of "highly polluting" products has paid a huge environmental price. Because the prices and tax policies of these products do not truly reflect their environmental costs, the profits of enterprises are largely obtained at the expense of the environment. According to experts’ calculation, the normal cost of controlling the pollutants discharged in the production process of "Shuanggao" products generally accounts for 10-30% of the total production cost, and the pollutants discharged in the production process of some products are even more difficult to control.

  For example, sodium dichromate products are produced by backward calcium roasting process in most enterprises in China, and the chromium slag produced contains "calcium chromate", which is recognized as a strong carcinogen by international authorities such as the World Health Organization. At present, China has not only left 4 million tons of chromium slag untreated, but also generated at least 500,000 tons each year, which poses a great threat to the public environment and human health. The state has to invest huge sums of money in governance and repay historical debts. In order to avoid paying new debts for such pollution, the state should strictly limit the production of these highly polluting products and cancel their export tax rebates.

  Pan Yue said that "high environmental risk" products have great risks to human health in production and use.,We must attach great importance to it. For example, the cadmium-nickel battery contains a large amount of cadmium, which is prone to chronic occupational diseases and acute poisoning events in the production process, thus causing lung disorders and serious damage to renal function of the relevant people. Even a small amount of cadmium, if ingested for a long time, will cause bone lesions and bring severe pain, which is collectively called "painful disease" in Japan. Due to cadmium pollution in Shentongchuan Valley, Toyama Prefecture, Japan, thousands of residents have suffered from "painful diseases" and become a world-famous pollution hazard. In recent years, cadmium poisoning and excessive cadmium in workers have occurred in some places in China, which has aroused great concern in society.

  Another example is that organic reagents containing arsenic (commonly known as "arsenic") are widely used as animal feed additives. Due to the function of biological chain, arsenic-containing wastes excreted by animals accumulate in soil in large quantities and are transformed into inorganic arsenic compounds with stronger toxicity. It not only seriously pollutes soil and water, but also causes central nervous system disorder after entering human body through food chain, which directly leads to the increase of the incidence of brain and optic nerve atrophy, and is particularly harmful to human health.

  Pan Yue particularly emphasized that in recent years, China has successively ratified the Rotterdam Convention on Prior Informed Consent Procedure for Certain Hazardous Chemicals and Pesticides in International Trade, the Stockholm Convention on Persistent Organic Pollutants and other international conventions on environmental supervision of chemicals. The proposal to cancel the export tax rebate and prohibit the processing trade of 39 kinds of products such as pesticides, paints, batteries and organic arsenic is not only responsible for China’s own environment and public health, but also a necessary action to fulfill its international obligations on environmental protection and establish the image of a responsible big country. By restricting the export of some "double-high" products and improving the export structure, it will not only promote the sustainable development of China’s trade, but also contribute to the care of the common home of mankind.

  Pan Yue also pointed out that WTO pursues the mutual coordination and promotion of trade and environment, and pursues sustainable development. Most of the main legal documents within the legal framework of WTO clearly stipulate that countries have the right to take "measures necessary to protect the life or health of human beings, animals or plants" to impose necessary restrictions on international trade. Therefore, the "double high" product list and related trade measures proposed by the State Environmental Protection Administration not only have distinctive "green trade" characteristics, but also fully comply with WTO rules.

  According to reports, the formulation of the "Shuanggao" product list began in the second half of 2006. In order to control the export of "high energy consumption, high pollution and resource" products, at the end of December, 2006, the State Council explicitly requested the Environmental Protection Administration, together with relevant departments, to draw up a list of products with high pollution and high environmental risks and establish a policy system to control the export of products with high energy consumption and high pollution.

  According to this arrangement, in 2007, the State Environmental Protection Administration organized trade associations and local environmental protection departments to conduct in-depth analysis and screening of products according to the needs of environmental management and macroeconomic regulation and control, according to the toxicity and treatment difficulty of pollutants discharged during product production, combined with relevant national industrial policies, industrial technical level and environmental conventions that China has joined, and formed the "double high" product list released this time on the basis of full consultation with relevant ministries and trade associations and expert argumentation.

  Pan Yue said that the State Environmental Protection Administration will also establish a dynamic management database of the "Double High" product catalogue, supplement new products and information at any time, and make it public at home and abroad in time. He expressed his belief that the publication of this directory will provide concrete and operable targets for the implementation of a series of environmental and economic policies such as green trade and green taxation, and the environmental protection department will, as always, take the initiative to cooperate with relevant economic authorities and work together to establish a practical environmental and economic policy system as soon as possible.
